







HOUSE CONCURRENT RESOLUTION NO. 88

Requesting the West Virginia Public Employees Insurance Agency and
the West Virginia Insurance Commission to conduct a study of
the impact of health care insurers mandating their insureds
use mail-order pharmacies to obtain prescription drugs on the
costs of health insurance, on West Virginia pharmacies, on the
insureds and on the citizens of this State.

Whereas, the citizens of West Virginia have an interest in
obtaining affordable health care coverage; and,

Whereas, the cost of prescription drugs has a significant
impact on health care costs; and,

Whereas, certain cost containment measures related to obtaining
prescription drugs benefit the citizens of West Virginia; and,

Whereas, the citizens of West Virginia have an interest in the
manner in which they obtain prescription drugs; and,

Whereas, certain health insurance policies or contracts require
that insureds acquire prescription drugs from mail-order
pharmacies; and,

Whereas, the Legislature finds that the citizens of West
Virginia would benefit from a study of the impact of mail-order
pharmacies; therefore, be it

Resolved by the Legislature of West Virginia:

That the West Virginia Public Employees Insurance Agency and
the West Virginia Insurance Commission are hereby requested to
conduct a study of the effects of mail-order pharmacies on health
insurance costs and the citizens of West Virginia; and, be it

Further Resolved, That the West Virginia Public Employees
Insurance Agency and the West Virginia Insurance Commission shall
present a final report to the Joint Committee on Government and
Finance, no later than its scheduled meeting in November, 2002, and
that the report shall contain the complete findings of the study
together with recommendations to the Legislature on actions that
may be taken to address any problems identified.
